This essay offers some lessons from the history of the United States Constitution for constitutions for emerging democracies in Eastern Europe. The United States Constitution declined in efficacy over time because special interests eroded its restraints on rent-seeking. This essay seeks to consider solutions to prevent constitutional decline. It suggests that since special interests will try to dissolve constitutional restraints, the original constitution should itself contain trigger rulers imposing new restraints when certain events occur that suggest the old restraints are (...) weakening. Thus in this essay I suggest creating constitutional provisions to spring into effect when the consequences of constitutional decline become apparent in the polity.Cet article met en avant quelques leçons puisées dans l’histoire de la constitution américaine pour les constitutions des démocraties naissantes de l’Europe Orientale. La constitution des Etats-Unis a perdu de son efficacité au fil du temps parce que les intérêts particuliers ont entamé les contraintes qui pesaient sur les activités de recherche de rente. Cet article essaye d’envisager des solutions pour contrecarrer le déclin constitutionnel. Il suggère que, puisque les intérêts particuliers essayent de dissoudre les contraintes constitutionnelles, la constitution devrait inclure, à l’origine même, des règles d’activation imposant de nouvelles contraintes quand certains évènements qui surviennent révèlent l’insuffisance des contraintes antérieures. Ainsi, dans cet article, l’auteur suggère la création de dispositions constitutionnelles qui sont activées quand les conséquences du déclin constitutionnel sont apparentes au niveau politique. The public accounting industry's voluntary code of conduct in the United States is the American Institute of CPA's Code of Professional Conduct. Based on our analysis, we conclude that the accounting industry's current code is limited in its ability to serve the public interest in three respects. Specifically, the code is input-based, requires no third-party attestation of compliance with the code, and contains no public reporting process of code compliance/noncompliance at the accounting firm level. We propose that the accounting profession (...) should reorient its largely input-based Code of Professional Conduct to include output-based performance measurements. We also conclude that third-party attestation of compliance with the profession's code would help to promote compliance. Finally, we maintain that the accounting industry should initiate a public reporting process at the individual accounting firm level. Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. PurposeTo use the power of knowledge acquisition and machine learning in the development of a collaborative computer classification system based on the features of age-related macular degeneration (AMD).MethodsA vocabulary was acquired from four AMD experts who examined 100 ophthalmoscopic images. The vocabulary was analyzed, hierarchically structured, and incorporated into a collaborative computer classification system called IDOCS. Using this system, three of the experts examined images from a second set of digital images compiled from more than 1000 patients with AMD. Images (...) were annotated, and features were identified and defined. Decision trees, a machine learning method, were trained on the data collected and used to extract patterns. Interrelationships between the data from the different clinicians were investigated.ResultsSix drusen classes in the structured vocabulary were largely sufficient to describe all the identified features. The decision trees classified the data with 76.86% to 88.5% accuracy and distilled patterns in the form of hierarchical trees composed of 5 to 15 nodes. Experts were largely consistent in their characterization of soft, and to a lesser extent, hard drusen, but diverge in definition of other drusen. Size and crystalline morphology were the main determinants of drusen type across all experts.ConclusionsMachine learning is a powerful tool for the characterization of disease phenotypes. The creation of a defined feature set for AMD will facilitate the development of an IDOCS-based classification system. (shrink)

L'article étudie la méthode de la théologie transcendantale et son application à la doctrine chrétienne de Dieu. Certains auteurs représentatifs de cette école théologique sont choisis, à savoir Lonergan, Donceel, Tracy et K. Rahner. Dans chaque cas trois questions sont posées: la relation entre expérience et notre compréhension de Dieu; la raison par rapport à la croyance en Dieu; le concept de Dieu qui ressort de l'emploi de la méthode transcendantale. Parmi les mérites de la méthode transcendantale il faut noter (...) sa rigueur intellectuelle et son ouverture au dialogue avec la non-croyance. Les auteurs dont il est question cherchent à montrer que la dimension religieuse est partie nécessaire de l'expérience humaine. Parmi les faiblesses on peut noter que les penseurs transcendantaux sont peut-être trop anthropologiques et ont une conception unilatérale de l'homme qui tend à négliger sa corporéité et son historicité. Leur affirmation sans compromis de la transcendance de Dieu fait aussi surgir la question comment l'apologétique chrétienne répond au problème de la souffrance humaine. La transcendance de Dieu ne doit-elle pas être compensée par son immanence afin que la relation de Dieu au monde ne soit pas unilatérale? (shrink)

"The explanation of any social phenomenon has to start by reducing it to the individual behavior patterns which gave rise to it, and moreover these behavior patterns have to be regarded as rational.... Policy and practice shifted to a multidisciplinary approach, recognizing the broad range of potential threats to public health, including biological, physical, radiological, and chemical threats. This propelled the development of surveillance systems to detect incidents, laboratory capacities to rapidly test for potential threats, and therapeutic and social countermeasures to prepare for and respond (...) to a range of hazards.
